AGREEMENT BETWEEN USER AND GIBBERONI
The Gibberoni Web Site is offered to you conditioned on your acceptance without modification of the terms, conditions, and notices contained herein. Your use of the Gibberoni Web Site constitutes your agreement to all such terms, conditions, and notices. Gibberoni reserves the right to change the terms, conditions, and notices under which the Gibberoni Web Site is offered, including but not limited to the charges associated with the use of the Gibberoni Web Site.
RESTRICTIONS AND PROHIBITIONS OF USE
All services provided by the Gibberoni Web Site may be used for lawful purposes only. Transmission, storage or presentation of any information, data or material in violation of any United States federal, state or city law is prohibited. This includes, but is not limited to: copyrighted material, material we judge to be threatening or obscene, or material protected by trade secret and other statute. The user agrees to indemnify and hold harmless Gibberoni from any claims resulting from the use of service which damages the user or any other party. Content may not be illegal, obscene, defamatory, threatening, infringing of intellectual property rights, invasive of privacy or otherwise injurious or objectionable.
Prohibited are sites that promote any illegal activity or present content that may be damaging to Gibberoni's servers, or any other server on the Internet. Links to such materials are also prohibited. If your account is found to have participated in any illegal activity, posting of any illegal MP3 files, pirated software, hacker programs, warez programs, or any other illegal files, your account will be terminated immediately, without notice. Additionally, Gibberoni will notify the proper authorities of your actions.
Any attempt to undermine or cause harm to a server or user of the Gibberoni web site is strictly prohibited. As a user, you are responsible for all your accounts. Should you violate the Terms of Services outlined within, your account will be cancelled without any kind of compensation.
VIOLATIONS
Violations of our policies should be referred to Team@Gibberoni.com. All complaints will be investigated promptly. Failure to follow any term or condition will be grounds for immediate account deactivation and site banning.
REFUSAL OF SERVICE
We reserve the right to refuse, cancel or suspend service, at our sole discretion.
LIMITATION OF LIABILITY
Gibberoni shall not be responsible for any claimed damages, including incidental and consequential damages, which may arise from Gibberoni's servers going off-line or being unavailable for any reason whatsoever. Gibberoni cannot be held liable for system down time, crashes or data loss. Furthermore, Gibberoni shall not be responsible for any claimed damages, including incidental or consequential damages, resulting from the corruption or deletion of any content from Gibberoni's servers. All damages shall be limited to the immediate termination of service. We reserve the right to remove any account, without advance notice for any reason without restitution, as Gibberoni sees fit.

The Gibberoni Web Site may contain links to other Web Sites. The Linked Sites are not under the control of Gibberoni and Gibberoni is not responsible for the contents of any Linked Site, including without limitation any link contained in a Linked Site, or any changes or updates to a Linked Site. Gibberoni is not responsible for webcasting or any other form of transmission received from any Linked Site. Gibberoni is providing these links to you only as a convenience, and the inclusion of any link does not imply endorsement by Gibberoni of the site or any association with its operators.
USER SUBMITTED CONTENT
Gibberoni does not claim ownership of the materials you provide to Gibberoni (including feedback and suggestions) or post, upload, input or submit to any Gibberoni Web Site or its associated services (collectively "Submissions"). No compensation will be paid with respect to the use of your Submission, as provided herein. Gibberoni is under no obligation to post or use any Submission you may provide and may remove any Submission at any time in Gibberoni's sole discretion.
By posting, uploading, inputting, providing or submitting your Submission you warrant and represent that you own or otherwise control all of the rights to your Submission as described in this section including, without limitation, all the rights necessary for you to provide, post, upload, input or submit the Submissions.
ACCOUNT ACTIVATION
By either activating your account or submitting any content to Gibberoni, you agree to the above policies and disclaimer. Upon requesting activation of an account, you are required to accept these policies, guidelines and disclaimer, and a copy of your acceptance is forwarded along with your activation request to be maintained with your account information. If you sign up for an account and fail to comply with these terms, no refunds will be given. We will, however, advise you by e-mail or phone prior to taking any action to provide you with an opportunity to correct the problem.
